Terms and conditions for Headmate

These terms (“the Terms”) govern your use of the Headmate mobile app, the related cloud service (API/sync), and where relevant, the website headmate.dk (together, the “Service”).
The Service is provided by Headmate (“Headmate”, “we”, “us”). By creating an account or using the Service, you accept the Terms. If you disagree, you must not use the Service.

1. What Headmate is (and is not)
Headmate is a digital tool to record and gain overview of migraine and headache and — depending on features and your choice — share overview with your clinician.
Headmate is not:
- a substitute for medical care, diagnosis, or treatment;
- emergency assistance in life-threatening situations.
In case of acute or severe symptoms, you must call 112 or seek immediate medical care.
You are responsible for seeking professional advice regarding your health condition.
2. Requirements for you
You must be of legal age under Danish law (typically 18) or have parental/guardian consent where required.
You must provide accurate information during registration and keep your account reasonably up to date.
3. Account, password, and security
You are responsible for protecting your password and your device. All actions performed through your account are attributed to you unless you can document misuse that you could not reasonably have prevented.
We may suspend or close an account if we suspect misuse, a security risk, or breach of the Terms.
4. Acceptable use
You must not:
- use the Service unlawfully (e.g. sharing illegal content in support);
- attempt to hack, reverse engineer, or overload systems;
- access other users’ data;
- use automated tools to extract data contrary to fair use (“scraping” against our servers).
We may remove content or limit features that violate these rules.
5. Your content and licence to us
Your records and texts belong to you. In order for us to provide the Service, you grant Headmate a non-exclusive, worldwide, royalty-free right to host, store, back up, synchronise, and technically process your data — solely to operate and improve the Service for you, and in accordance with our privacy policy.
You can at any time delete large parts of your data or your entire account in the app (see below).
6. Headmate+ and payment
Headmate+ is an optional subscription with extended functionality. Purchases and renewals are made through the Apple App Store and/or Google Play and are subject to their terms and conditions.
For purchases through the Apple App Store, Apple’s standard end user licence agreement (EULA) also applies.
- Prices are shown in the store and may change with notice under the store’s rules.
- Cancellation and refunds primarily follow Apple’s or Google’s policies.
- Headmate may change what is included in Headmate+ with reasonable notice (e.g. in the app or on the website).
Our backend updates subscription status based on information from the store and our subscription provider (e.g. RevenueCat) to lock or unlock features.
7. App updates
The app may receive updates through App Store/Google Play. Certain updates may be necessary for continued use or security. We recommend keeping the app updated.
8. Intellectual property rights
All content in the Service (design, text, logo, code, graphics) that does not originate from you belongs to Headmate or our licensors. You may not copy or resell it without written agreement.
9. Availability and changes to the Service
We aim for high availability, but we do not guarantee uninterrupted operation. We may change, expand, or discontinue individual features with notice where reasonable.
Planned maintenance may result in short downtime.
10. Limitation of liability
To the extent permitted by Danish law:
- Headmate is not liable for indirect loss, operational loss, loss of data due to your device, or consequential damages;
- our total liability to you as a consumer is limited to the amount you have paid to Headmate for the Service in the last 12 months — except for damages that cannot be limited by law (e.g. intent or gross negligence, or personal injury under mandatory Danish consumer law).
Headmate does not replace clinical or financial decisions you make based on data in the app.
11. Termination and account deletion
You may delete your account in the app at any time (where the feature exists). Deletion as a rule entails permanent removal of your personally identifiable data in our primary user database in accordance with our privacy policy (including migraine logs and profile). Certain anonymised statistics may be retained without personal references.
We may terminate your access in case of material misuse, or if we need to close the Service — in the latter case with notice where possible.
12. The website headmate.dk
The website is provided as information about the product. Content may change without notice. Links to third parties (e.g. App Store) are provided for convenience only; we do not control third-party sites.
13. Governing law and venue
The Terms are governed by Danish law.
If you are a consumer residing in Denmark, you may bring disputes before courts in Denmark under mandatory rules.
14. Changes to the Terms
We may update the Terms. The current version is published on headmate.dk with a date. For material changes, we may provide notice in the app or by email. Continued use after entry into force constitutes acceptance, unless the law requires separate consent.
15. Miscellaneous
If a provision is invalid, the remaining provisions remain in force. Failure to enforce does not constitute waiver of rights.
16. Third-party terms
Your use of Apple, Google, RevenueCat, etc. is also subject to their user terms and privacy policies.
